Conditions d'utilisation
Ce document est disponible en anglais, qui est la version qui fait foi.
Version: v1.0-draft (2026-06-17)
Jurisdiction: British Columbia, Canada
These Terms of Use ("Terms") are a binding agreement between you ("Rider", "User", "you") and LuxRide Technologies Inc. ("LuxRide", "we", "us"). By creating an account, tapping "I agree", or using the LuxRide app or services, you accept these Terms.
1. Who can use LuxRide
You must be at least 19 years old (age of majority in British Columbia) and able to enter a binding contract. You must provide accurate registration information and keep it up to date. Your account is personal and may not be shared or transferred.
2. What LuxRide provides
LuxRide operates a technology platform and a premium ground-transportation service in the Metro Vancouver area, connecting Riders with vehicles and drivers for pre-arranged and on-demand trips, transfers, airport service, and related premium experiences. The exact regulatory classification of the service (e.g., transportation network service vs. limousine/passenger directed vehicle) is being confirmed; service availability depends on LuxRide holding the required provincial, municipal and airport authorizations.
3. Bookings, fares and payment
- Fares are shown or estimated in the app before you confirm, in Canadian dollars (CAD), and may include a base amount, time-based charges, applicable taxes, tolls, airport fees, parking and waiting time.
- Estimates are not guarantees; the final amount may change if the route, duration, stops or conditions change.
- You authorize LuxRide and its payment processor to charge your selected payment method for confirmed bookings and any applicable fees described in these Terms.
- Additional fees may apply for cleaning, damage, lost-item return, excessive waiting or other situations described in our policies.
4. Cancellations and no-shows
Cancellation and no-show fees may apply as described in the Cancellation and No-Show Policy. We aim to be fair and will describe any fee before it is charged where reasonably possible.
5. Your conduct
You agree to treat drivers and vehicles with respect; not to bring illegal items; not to be abusive, threatening or discriminatory; to wear a seatbelt; and to comply with applicable law and our Community Guidelines. Smoking, illegal drug use and unlawful activity are prohibited in vehicles.
6. Children and minors
Children under 16 must be properly secured in a car seat, booster or seatbelt appropriate to their age and size, as required by BC law. You are responsible for providing and correctly installing an appropriate child restraint unless LuxRide expressly offers one for the booking.
7. Accessibility and service animals
LuxRide does not discriminate. Certified guide dogs and service dogs are welcome in accordance with BC law. Accommodation needs can be indicated in the app or to support.
8. Bookings made for others (third-party bookings)
If you book on behalf of another passenger (e.g., as a hotel, concierge, company, family member or assistant), you confirm you are authorized to do so, that you will share relevant trip and safety information with the passenger, and that you remain responsible for the booking and payment as set out in the Booker / Third-Party Reservation Terms.
9. Damage, cleaning and lost items
You are responsible for damage or excessive soiling caused by you or your guests, and reasonable fees may be charged. LuxRide will make reasonable efforts to help return lost items but is not responsible for items left in a vehicle.
10. Privacy
LuxRide collects and uses personal information in accordance with the LuxRide Privacy Policy and applicable law (BC PIPA and Canada's PIPEDA). Marketing communications are sent only with your consent (Canada's CASL), which you may withdraw at any time.
11. Service "as is"; no guarantees
The service is provided on an "as is" and "as available" basis. To the extent permitted by law, LuxRide does not guarantee uninterrupted availability, a specific driver or vehicle, exact arrival times, or that the service will be error-free.
12. Limitation of liability
To the maximum extent permitted by applicable law, LuxRide is not liable for indirect, incidental, special or consequential damages, or for events beyond our reasonable control. Nothing in these Terms limits liability that cannot be limited under applicable law (including certain rights under BC consumer-protection law). (Scope and enforceability of this clause to be confirmed by BC counsel.)
13. Indemnity
You agree to indemnify LuxRide for losses arising from your breach of these Terms, your misuse of the service, or your violation of law or the rights of others, to the extent permitted by applicable law.
14. Suspension and termination
We may suspend or close accounts that breach these Terms, create safety or legal risk, or for other reasons described in our policies, subject to applicable law.
15. Changes to these Terms
We may update these Terms. We will make the current version available in the app and, where the changes are material, ask you to accept the new version. Continued use after an update means you accept it.
16. Governing law and disputes
These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable there. Disputes are subject to the courts of British Columbia. (LuxRide is intentionally not adopting a mandatory foreign-seat arbitration clause; see the note on Uber v. Heller in the legal-review section.)
